By installing our Chrome extension, visiting our website, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

2. User Eligibility and Registration

Our Service primarily consists of a Chrome extension designed to enhance AI prompts. By using our extension, you acknowledge and agree that:

• The extension requires certain browser permissions to function properly, which are only used for the purposes described in our Privacy Policy.
• We provide the Service on an "as is" and "as available" basis. We do not guarantee that the enhanced prompts will always meet your specific needs or expectations.
• We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
• You will not attempt to reverse engineer, decompile, or otherwise attempt to derive the source code of our extension.
• You will not use the Service for any illegal purpose or in violation of any local, state, national, or international law.

4. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

5. User Generated Content and Prompts

The Service allows you to input and enhance AI prompts. With respect to the content you submit to our Service:

• You retain all ownership rights in your original prompts.
• By submitting prompts for enhancement, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your prompts solely for the purpose of providing and improving the Service.
• You understand that anonymized data about prompts and enhancements may be used to train and improve our systems.
• You represent and warrant that your content does not violate any third-party rights and complies with all applicable laws and regulations.

6. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your information.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your user content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

10. Termination

We may terminate or suspend your access to all or part of the Service, with or without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms, applicable laws, or is harmful to the interests of another user, a third party, or us.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Refund Policy

We offer a 7-day money-back guarantee on all new paid subscriptions to our Service. If you are not satisfied with your subscription for any reason, you may request a full refund within 7 days of your initial purchase by contacting us at support@prompt-engineered.com.

To be eligible for a refund:

• The refund request must be made within 7 days of the initial purchase date
• The request must be submitted directly to our support team via email
• You must include your account information and the reason for requesting a refund

After the 7-day period has expired, we do not offer refunds for the following reasons:

• Requests made after the 7-day money-back guarantee period
• Dissatisfaction with the Service after the refund period has expired
• Changes in personal circumstances or financial situations
• Accidental purchases, unless reported within the 7-day window

For subscription plans, cancellation of your subscription will stop future billing but will not generate a refund for the current billing period unless the cancellation is within the initial 7-day money-back guarantee period for new subscriptions.

We reserve the right to deny refund requests that do not comply with these conditions, or if we detect abuse of our refund policy, including but not limited to repeated subscription and cancellation patterns.

Approved refunds will be processed to the original payment method used for the purchase within 5-10 business days, depending on your payment provider's policies.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the state of California, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the state of California, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
